Participation Contract for EroFest 2027
An electronic participation form for EroFest 2027 under Section 1746(2) of Act No. 89/2012 Coll., the Civil Code, concluded on the day, month and year stated below between the exhibitor and FOTION, s.r.o. (hereinafter the „Electronic Form“). The contract is concluded in Czech and the Czech wording is the binding one; this English text is provided for your understanding only.

The exhibitor’s details are filled into the contract from the submitted application.
Prices are stated in CZK and exclude VAT. VAT will be added to the prices in line with the regulations in force.
Annex No. I to this contract, forming an integral part of it, is the order list for the services supplied by the organiser, that is, the recapitulation of this electronic application.
Art. I Subject of the contract
Under this contract the organiser undertakes to provide the exhibitor with space at the Erotic Fair according to the specifications set out below and in Annex No. I to this contract.
The exhibitor undertakes to pay the registration fee, to pay for the rented space specified in Annex No. I to this contract, and to occupy that space on the days of the fair.
Art. II Binding registration for the fair
The Erotic Fair is held on 23–24 April 2027 at PVA EXPO Praha Letňany, Beranových 667, 199 00 Praha 9 — Letňany. The fair runs from 13:00 to 23:00 on the first day and from 11:00 to 23:00 on the second day. An afterparty in a separate hall is part of the fair on each day once the fair closes. Stands are built on the day before the fair opens, from 8:00 to 23:59. Clearing of the stands begins after the fair closes at 23:00 and must be completed by 9:00 the following day.
The exhibitor shall send the completed contract together with the electronic form to the organiser, either on paper or electronically. Once the organiser confirms receipt of the contract electronically or in writing, the contract on participation in the Erotic Fair is deemed to have been duly concluded.
By confirming receipt of the completed contract together with Annex No. I, the organiser undertakes to provide the exhibitor with the space and the additional services set out in the electronic order; the exhibitor undertakes to pay for them according to the invoice issued and to occupy the space on the days of the fair.
Once the contract is concluded, the exhibitor is obliged to send the electronic materials to be used for the presentation ordered in the electronic order. The exhibitor sends the electronic application through the online form.
A paper application is to be sent by the exhibitor to: FOTION, s.r.o., Plzeňská 172c, 153 00 Praha 5.
Art. III Rented exhibition space
The exhibitor shall pay for the rented exhibition space and the additional services specified in this electronic order a price equal to the sum of all services ordered. The organiser offers four ways of renting the space:
A) RETAIL STAND (paid per square metre) — the standard rate for renting each m².
B) RETAIL STAND (commission of 20% of takings) — rent based on turnover at 20% of takings. In this case the tenant pays nothing for the exhibition space. The tenant pays the registration fee (CZK 2,000) and any further services ordered, such as electricity, internet or the rental of additional terminals. The organiser lends the tenant one payment terminal free of charge and the tenant accepts payments by card or in cash. The terminal then splits the takings between the exhibitor and the organiser. The tenant also pays a deposit of CZK 10,000, which is returned once the account is settled and the terminal handed back.
C) FOOD AND DRINK (commission of 25% of takings) — rent based on turnover at 25% of takings. In this case the tenant pays nothing for the exhibition space. The tenant pays the registration fee (CZK 2,000) and any further services ordered, such as electricity, internet or the rental of additional terminals. The organiser lends the tenant one payment terminal free of charge and the tenant accepts payments by card or in cash. The terminal then splits the takings between the exhibitor and the organiser. The tenant also pays a deposit of CZK 10,000, which is returned once the account is settled and the terminal handed back.
D) NON-RETAIL STAND (paid per square metre) — the standard rate for renting each m².
The chosen form of rental and cooperation is subject to the organiser's approval.
Art. IV Payment terms
The exhibitor shall pay the price for the rented exhibition space together with the additional services under Art. III on the basis of an invoice, within the due date stated on the invoice.
All prices are stated excluding VAT; VAT will be added to the prices in line with the legislation in force.
The exhibitor shall inform the organiser of the payment made without delay, by sending an e-mail together with a bank statement to info@erotickyveletrh.cz.
Art. V Withdrawal from the contract
Withdrawal from the contract is possible only in writing, addressed to the organiser. A withdrawal addressed to the organiser must state the reason for termination.
Art. VI Cancellation fee
The organiser reserves the right to charge a cancellation fee if the exhibitor withdraws from the contract.
Withdrawal by the following dates:
- 1. 9. 2026 0% of the amount under Art. III
- 1. 12. 2026 50% of the amount under Art. III
- 23–24 April 2027 100% of the amount under Art. III
Art. VII Layout of the stands
The organiser has the deciding say in the final layout of the stands, subject to what is possible at the time.
The organiser records the layout of the individual stands in a floor plan as it goes. The organiser will provide this plan to the exhibitor on request.
Art. VIII Liability for damage
The exhibitor is fully liable for damage caused to the rented exhibition space and to any equipment provided by the organiser. Should damage occur, the exhibitor shall inform the organiser without delay and together with the organiser draw up a record of the extent of the damage and of how the situation is to be resolved.
The exhibitor is fully liable also where such damage was caused by an employee of theirs or by another person acting on their behalf.
Art. IX Organiser's liability
The organiser is not liable for any damage to exhibitors' property that may arise on the exhibition grounds.
Nor is the organiser liable for any injury to health suffered on the exhibition grounds during the event.
The parties declare that they are entering into this contract and agreeing the rights and obligations under it in full awareness and knowledge of the content and effects of measures adopted by public authorities in connection with the spread of a health-threatening infection. Given that the duration and content of any further measures adopted by public authorities, and the extent of their effects on the organiser's ability to perform its obligations under this contract, cannot be foreseen at this time, the parties agree that should further measures be adopted in connection with the situation described above, or should the existing measures be extended in such a way as to materially change the organiser's ability to perform under this contract, and should the organiser expressly declare this to the exhibitor, the exhibitor is obliged to accept the postponement of the fair to a replacement date announced by the organiser (hereinafter the „new event date“). With the aim of arranging the contractual relationship reasonably and fairly, the organiser undertakes that all services ordered and the related obligations shall, in the event of measures adopted by public authorities affecting the organiser's obligations under this contract, be transferred to the new event date; the exhibitor fully agrees to this and declares that in such a case they will give the organiser their full cooperation and will not regard the transfer of the services ordered and the related obligations towards the organiser as a manifest abuse of their rights.
Art. X Resolution of disputes
Any disputes arising in the course of performance of the contract shall be resolved primarily by mutual agreement between the organiser and the exhibitor. A written report shall be drawn up on such an agreement, setting out a position that is binding on both the exhibitor and the organiser.
Where disputes are not resolved by mutual agreement between the organiser and the exhibitor, they shall be decided by the competent authorities. For disputes not subject to exclusive jurisdiction, the parties establish the local jurisdiction of the courts seated in Prague.
Art. XI Promotion of the exhibitor
The exhibitor undertakes to supply all materials that are to form part of the promotion under Art. III and Annex No. I. Should the exhibitor fail to supply these materials in accordance with the organiser's instructions and by the proper deadline, the organiser's obligation to carry out that promotion ceases, with no right to a refund.
Where the exhibitor uses music as part of their presentation, they may do so only on condition that the music does not disrupt the running of the event. In particular, it must not disturb other exhibitors or drown out the official sound production. Should the organiser consider the music unsuitable, it reserves the right to call on the exhibitor to stop.
The organiser undertakes to provide the exhibitor with all the promotion ordered under this electronic form and this contract. Should it fail to do so, it is obliged to refund the exhibitor the amount the exhibitor paid under the electronic form.
Art. XII Opening of the grounds for occupying the exhibition space
For the building of stands, the fair grounds open on build-up day from 8:00. Within that time the exhibitor must occupy their space and prepare it for the fair. Should any complications arise, the exhibitor is obliged to inform the organiser without delay and to resolve them together.
Art. XIII Handover of the exhibition space
Once the fair has ended, the exhibitor is obliged to hand the exhibition space back to the organiser no later than 8 hours after the official close of the event. The organiser shall draw up a handover record confirming that all obligations have been settled and that the space and any borrowed equipment have been returned, or stating the extent of any damage caused to the exhibition space or the borrowed equipment. The handover record shall state how the obligations are to be settled or the damage to the borrowed equipment or the exhibition space made good.
Art. XIV Final provisions
Any changes and additions to this contract may be made only in writing, by agreement between the organiser and the exhibitor.
The exhibitor undertakes not to disrupt the running of the event by preparing their exhibition space late. Sufficient time for that preparation is provided under Art. XII. From the moment the first visitor is admitted to the fair, the exhibitor may not disrupt the running of the event by preparing their exhibition space. Should the exhibitor fail to make adequate arrangements and not have their space ready, or should they still be preparing it when the first visitor is admitted, the organiser shall charge a contractual penalty of up to CZK 20,000.
Should unforeseeable circumstances arise (force majeure) and the organiser be unable to open the fair or to hold it in full, it shall inform the exhibitor without delay. In such a case the exhibitor has no claim to compensation for any damage incurred.
Should the exhibitor fail to take up their place at the fair at least 3 hours before the event opens to visitors, the organiser shall fill the exhibition space as best it can, and the exhibitor's right to occupy the space ceases with no possibility of a refund. Failure to occupy the exhibition space is regarded as a serious breach of the contractual terms and entitles the organiser to terminate the contract.
The exhibitor may claim for work and services provided by the organiser in writing, supported by photographic evidence, during the fair itself and no later than the official close of the fair.
The organiser may impose a penalty of up to CZK 20,000 should the exhibitor leave the fair before its official close or fail to have their stand ready in time.
The annex to this contract is the order list for the services supplied by the organiser.
This contract is drawn up in two counterparts, each with the force of an original.
Having read the contract, the parties declare that they have legal capacity and agree with its content. The contract is binding on the parties and enforceable in court. It has been concluded on the basis of the serious and free will of the parties, without any duress or material error, which the parties confirm by submitting the form.
